The developer at 11 Chris Bang Cres has submitted yet another Development Approval to council to address the illegal building works that council has placed a stop work order on last year.
Ultimately, the correct course of action is for the council to reject this application. It is incumbent on the applicant to propose plans to ensure the development complies with already approved 2016 development plans and Waverley (DCP) 2012. The practical, technical, and financial requirements to do so lie entirely at the feet of the applicant.

This is the third DA attempting to retrospectively approve the overbuild.
The attempt in June 2021 was withdrawn.
The attempt in December 2020 was not approved.
Community objection was an important factor.
The ongoing argument in this new Application is basically that the overbuild is not significant.
If this was the case then council would have approved all their last DAs - obviously council thought the illegal work was significant.
There is a little attempt to correct the building works, or reduce the physical structure back to its approved size. The only real change is the blocking of access to a roof terrace.
